Seditious Conspiracy

Offered not as legal advice, but as the basis for your own investigation into how First Amendment speech rights interact with Federal criminal statutes:

Seditious conspiracy is a federal crime under Title 18 US Code Section 2384. It states:

“If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.”

Additionally, Title 18 US Code Section 2385 makes it a crime to advocate overthrowing of the government, and Title 18 US Code Section 2383 makes assisting, inciting, or engaging in rebellion/insurrection a crime, as well.

Most of the cases interpreting the seditious conspiracy statute date from the World War I era, but there are a couple of recent cases involving purported Islamic terrorism, in which they had engaged in training and had exhorted people to make war on the US.

Of course every government is going to make their removal from power a crime. The thing of it is I don't view them as the highest authority. That's what really pisses off the left. Jesus Christ is my highest authority. I have a God given right to challenge all earthly powers. It is easy for the gub'mint to exercise these laws over a few but over a million or so, forget it!!
Surrender is not a part of the American Code of Honor. The gub'mint came looking for a fight. We have taken every avenue trying to avert such actions. The gub'mint has kept up their relentless pursuit of our liberty and freedom. The more ground that we gave the more ground the gub'mint took. We now find ourselves with our heels at the edge of a very deep and dark ravine. Our hopes and dreams have been crushed under the boots of the government thugs. Our children and grandchildren are being shackled with the chains of slavery.
Okay Mr. Government you have pushed us to the edge and brought along the music. LET'S DANCE!!!

So, serious question here by someone who wishes to leave the country a better place rather than a worse one, if you were to say to another person something like 'this government has overthrown the Constitution and I seek to restore it' would that be sedition? Half of this country no longer pays federal taxes and half does? Is the republic restore-able without threat of force? yeah, and amnesty talks start next week.
